
Fitness for Human Habitation (FFHH) Requirements for Landlords in Wales
From December 1, 2022, all rental properties in Wales must meet Fitness for Human Habitation (FFHH) standards. Here’s a simplified guide to help landlords understand the requirements and ensure compliance.

What Does FFHH Mean for Landlords?
Under the new occupation contracts, landlords must ensure their property is in good repair and fit for human habitation throughout the entire tenancy. This is in addition to your responsibility to carry out necessary repairs.
What Makes a Property Unfit for Human Habitation?
There are 29 conditions that could make a property unfit for human habitation, similar to the existing Housing Health and Safety Rating System (HHSRS). Landlords should assess their properties for any potential hazards that could harm tenants.
Electrical Safety (EICR)
Electrical installations must be inspected and tested every five years (or sooner if required by the report).A current Electrical Installation Condition Report (EICR) must be provided to tenants within 14 days of the tenancy start.
If repairs are needed, written confirmation of the work must be provided to the tenant within 7 days of completion.
Consequences of Non-Compliance
Legal Action: Tenants can take landlords to court if the property is deemed unfit, seeking compensation and requiring repairs. Some occupation contracts allow tenants to stop paying rent until the court resolves the issue.Restrictions on Eviction: Landlords cannot serve a Section 173 (similar to the old Section 21) notice to reclaim possession of the property if the FFHH standards, including electrical and fire safety, are not met.
